The European Accessibility Act (EAA): A Guide for Businesses

What is the European Accessibility Act?

The European Accessibility Act (EAA) is an EU law that takes effect on June 28, 2025, aimed at improving accessibility for people with disabilities across the European Union (EU). The EAA complements existing EU legislation and sets minimum standards for accessibility.  It harmonizes accessibility requirements across member states, ensuring that essential products and services are accessible to all.

What Does the EAA Cover?

The EAA applies to key industries where accessibility barriers are most prevalent. The affected products and services include but are not limited to the following examples, subject to certain exemptions:

  • Technology & Digital Services: Computers, operating systems, smartphones, and e-books.

  • Banking & Finance: ATMs, banking services, payment terminals, and e-commerce platforms.

  • Telecommunications & Media: Telephony services, TV equipment, e-books and audiovisual media services.

  • Transport & Public Services: Ticketing and check-in machines, digital services for air, bus, rail, and waterborne transport.

Why is the EAA Important?

Accessibility is a fundamental right. The EAA promotes inclusion and equal opportunities, benefiting millions of people with disabilities. By removing barriers, the Act enhances user experiences, improves digital interfaces, and supports accessible transportation and financial services. For businesses, it aims to remove barriers to growth and market access and reduces costs by harmonising accessibility compliance requirements across the EU.

Consequences of Non-Compliance

Failure to comply with the EAA can lead to:

  • Financial Penalties: Hefty fines, varying by country, with some exceeding €3 million.

  • Legal Action: Lawsuits from advocacy groups or affected individuals.

  • Market Exclusion: Non-compliant products/services may be withdrawn.

  • Reputational Damage: Negative publicity that affects brand perception.

  • Business Disruption: Companies may need to make costly last-minute changes to remain in the market.

EAA Compliance Requirements

While the EAA does not define specific technical standards, EN 301 549 serves as the primary compliance benchmark. This standard aligns with Web Content Accessibility Guidelines WCAG 2.2. Companies should ensure their digital assets conform to these criteria.

Additionally, national laws implementing the EAA require:

  • Accessibility Training: Employees must be trained on accessibility standards.

  • Ongoing Monitoring: Regular audits and updates to maintain compliance.

  • Accessibility Statements: Public documentation outlining accessibility features, compliance efforts, and complaint procedures.

Steps to Ensure EAA Compliance

With less than five months to go, businesses should act now:

  1. Assess Applicability: Determine whether products and services fall within the EAA’s scope.

  2. Map Out Accessibility Requirements: Identify specific obligations.

  3. Establish Cross-Functional Teams: Involve developers, UX designers, legal teams, and supply chain partners.

  4. Evaluate Existing Products & Services: Conduct an accessibility audit and address priority issues.

  5. Develop an Accessibility Strategy: Implement compliance measures, update accessibility statements, and integrate accessibility into new product development.

Preparing for the EAA Deadline

The June 28, 2025 deadline is fast approaching. Companies must take immediate steps to ensure compliance, avoid legal risks, and embrace the benefits of accessibility. By prioritizing accessibility, businesses contribute to a more inclusive and equitable society while gaining a competitive edge.
